Additional charges will apply.(note, we do not offer skidding or crating services for countries requiring wood packaging with ISPM 15 certification)
  • Shipping or Carrier Pickup: If you are sending in a carrier on the scheduled removal/check out dates please ensure the driver has a copy of the BOL and knows your paddle number.  It is recommended that you forward our office a copy of the BOL and advise the pickup date.  Please email buyit@activeauctionmart.com and include your paddle number in the subject line.

Auctioneers Terms and Conditions

Subject to additions and deletions prior to the sale and at the time of the auction.  All bidders participating in the auction shall be bound by the following terms & conditions. 

  1. A Buyers Premium of 18% will be in effect for this auction.  The auction is conducted and payable in Canadian Funds.
  2. Terms of the sale are Cash, Debit, Visa, MasterCard, Wire Transfer, ACH, e-transfer (buyit@activeauctionmart.com) or direct deposit.   We do not accept checks (cheques) in any form.   On site payment is not available. 
  3. Payments: Accounts must be settled no later than 5PM PST the business day following the auction close day and before any items may be removed from the premises. 
  4. Payment will be processed for invoices up to $4000.00 Canadian using the credit card on file with Bidspotter unless prior arrangements have been made. Any invoices exceeding $4000.01 will require payment by Wire, EFT, ACH, Direct Deposit or E-transfer.  Contact our office for our banking details. No title shall pass to the Buyer until the total purchase price and all Taxes have been paid to Active Auction Mart Ltd.
  5. Invoices:  Each successful online bidder will receive an invoice / winners notification by email.  It is your responsibility to ensure you receive this email. 
  6. Taxes:   All buyers are subject to GST 5% and 7% PST and shall be paid to the Auctioneer at the time of sale.  Foreign buyers can apply to the CRA for a refund.  PST Exempt buyers must provide a valid PST # at time of registration.  If the Buyer does not register with their proof of tax exemption full taxes will be charged. The buyer can then request a tax refund with the CRA.
  7. The Auctioneer has the right to delete, remove or alter lots prior to or duriing the sale.
  8. The Auctioneer reserves the right to refuse any applicant the privilege of bidding on the auction and may revoke such privilege at any time.
  9. All items are sold “AS IS, WHERE IS” and lie at the purchasers risk immediately
  10. All sales “FINAL”
  11. The listing catalog is meant merely as a guide. The Auctioneer believes the descriptions contained herein to be correct, but makes no warranty in connection therewith. Descriptions shall not be relied on for accuracy or completeness. Bidders/Buyers shall be deemed to have inspected all items sold at Auction ("Items") before bidding and to have relied solely on their own inspections and investigations. Auctioneer and seller shall not be liable  for any inaccurate description of any Item or lot whether contained in a catalogue, advertisement or otherwise
  12. The items have been displayed for inspection and each purchaser shall be held satisfied as to the condition, identity and authenticity and shall not be entitled to make objection after the sale on any grounds whatsoever.
  13. The Auctioneer assumes no responsibility or any liability once title passes, which occurs at time of payment in full. Buyers are advised to prearrange for insurance coverage of their purchase. Title will revert to the Seller in the event the Buyer does not remove Item(s) within the time specified.  Any lots / items not removed after 15 calendar days will be deemed abandoned and will no longer be available.
  14. If the Auctioneer is unable to deliver an Item sold to a Buyer due to fire, theft or any other reason whatsoever, the Auctioneer shall reimburse Buyer for all monies paid to the Auctioneer in respect of the Item and the Auctioneer shall have no further liability to Buyer arising from or relating to such loss, including without limitation, any damages or loss of profits.
  15. In any case of dispute the Auctioneers decision shall be final.
  16. The auction company is providing the contracted services of BidSpotter.com as a convenience to prospective purchasers and in no way is this to be considered an exceptional right, any disruption in the broadband network and or phone lines that may disrupt the internet biding service will not be held against the auction company or BidSpotter.com there is a potential risk of bids being missed due to system lags or human error that can happen in real time, I acknowledge this risk and agree that the auction company or BidSpotter.com will not be held liable in any fashion what so ever.
  17. All Bidders must provide their FULL NAME, COMPLETE ADDRESS, PERMANENT ADDRESS and a valid DAYTIME PHONE NUMBER & EMAIL ADDRESS at which they can be contacted at the time of registration.
  18. Removal:  All items must be removed from the premises by the dates listed per auction and only upon full payment.  Any lots/items remaining after 15 calendar days shall be considered abandoned will no longer be available. 
  19. Removal hours are as posted per auction and must be adhered to unless otherwise specified or arranged.  
  20. Cost and responsibility of removal remains with the Buyer.
  21. Shipping may not be available from this location.  Please check the individual auction details.  If you choose to send in a carrier please ensure they will pick up AS IS / WHERE IS, not skidded or packaged.  Please set up shipping with your own carrier and reference your Bidder number on the bill of lading.  Note:  We are not an ISPM15 certified facility.  
  22. Each shipment is subject to handling, palletizing, packaging fees and rigging fees depending on the item(s) purchased.  Please contact us for a list of fees by calling 604-371-1190 or by emailing buyit@activeauctionmart.com
  23. Default:  Bidders must bid only on those items they are prepared to pay for and remove in accordance with the terms and conditions of this sale.  All items awarded to the high Bidders must be paid for by the Final Payment Date and removed by the Final Removal Date unless stated by Active Auction Mart Ltd in writing.  If the Buyer fails to perform contractual obligations (payment and removal).  Buyer will be deemed to be in default and Active Auction Mart, at its option, may scrap, remarket or resell the property, in which event, Buyer will be liable for all losses incurred including the difference between Buyers Winning Bid Price and the Resale price, costs of resale and any losses incurred by Active Auction Mart Ltd or Active Auction Mart Ltd clients as a result of the buyers default.
