These are the complete and only terms and conditions on which all property is offered for sale. All Bidders and other persons participating in this sale agree that they have read and have full knowledge of these terms and agree to be bound thereby. All Items are listed to the best of the auctioneer’s ability, but are sold AS-IS with no warranty expressed or implied. Under these Terms and Conditions, the term “Bidder” and “Purchaser” shall be used interchangeable and be one of the same. By bidding in this auction, prospective bidders agree to be bound by the following:

Registration. All bidders must register their name, permanent street address (no P.O. Boxes please), and phone number prior to the auction. Bidders will be required to register with a credit card for verification purposes.

Terms of Sale. The highest bidder for each lot shall be the buyer, and if any dispute arises as to any bidding, or between two or more bidders, at the sole discretion of the auctioneer, the disputed lot shall be put up again at the last undisputed bid and resold. All sales as-is, where-is, all sales FINAL with no warranty or fitness of merchantability implied.

Buyer's Premium. Auctioneer will charge and retain a non-negotiable 18% buyer's commission from the proceeds of any sale on the final bid of each lot sold ('Buyer's Premium').

Taxes. Where required by law, Buyer shall pay Auctioneer sales tax. Tax will be added to the purchase price of all purchased items, as well as the Buyer's Premium. At the time of payment, dealers who purchase for resale must supply a completed copy of the tax-exempt form.

Payment. Buyer's credit card used during registration will be charged the next day after the auction for the winning bid plus buyer's premium and all applicable fees, unless Buyer reaches out to Alex Cooper Auctioneer's Inc. to request payment via ACH and wire transfer. Credit card payments are subject to a 3% processing fee. Payment is due in full within 48 hours after the end of the auction.

Condition of Articles Sold and Lot Descriptions. Alex Cooper Auctioneers, Inc. does not warrant the condition of any lot sold. ALL PROPERTY IS SOLD “AS IS”, and neither Alex Cooper Auctioneers, Inc. nor the consignor makes any warranties or representations of any kind or nature with respect to the property or its value, and in no event shall they be responsible for correctness of description, genuineness, attribution, provenance, authenticity, authorship, completeness, condition of the property or estimate of its value. No statement (oral or written) in lot descriptions, at the auction, or elsewhere shall be deemed such a warranty or representation, or any assumption of responsibility. Prospective bidders are urged to contact Alex Cooper Auctioneers, Inc. directly for additional information regarding any lot. THERE SHALL BE NO RETURNS FOR ANY REASON. The maximum obligation of Alex Cooper Auctioneers, Inc. for any disputes is to refund the purchase price. After the Auction Successful bidders are expected to pay for their purchases immediately. IF PAYMENT IS NOT RECEIVED WITHIN 48 HOURS, BIDDERS AUTHORIZE ALEX COOPER AUCTIONEERS, INC. TO CHARGE THEIR PURCHASES TO THEIR CREDIT CARD LEFT ON FILE.

Shipping. It is the buyer's responsibility to arrange packing and shipping of any and all lots purchased. It is the responsibility of the buyer to pay for all shipping and handling charges. Alex Cooper Auctioneers, Inc. will need to see a paid invoice before removing any and all purchases.

Removal. No items may be removed until the auction is completed, and payment has been made in full. After payment is received in full by Alex Cooper Auctioneers, Inc., Buyer will be given until close of business at 4:30 pm (ET) on Monday, March 31, 2025 to remove any items purchased. If additional time is needed buyer MUST get approval from Alex Cooper Auctioneers, Inc. IF ITEMS ARE NOT REMOVED WITHIN THIS TIME FRAME, BUYER FORFEITS ITEMS AND ANY PAYMENTS RECEIVED BY Alex Cooper Auctioneers, Inc. Removal of items at other specified location require an appointment to be made by Buyer with Alex Cooper Auctioneers, Inc. to schedule pickup. Removal shall be at the expense, risk and liability of the Buyer. 

Removal Procedures. 1. NO MERCHANDISE WILL BE RELEASED DURING THE AUCTION SALE. 2. Pay your invoice in full. After payment is received in full by Alex Cooper Auctioneers, Inc., a release form will be given to the buyer. This form MUST be shown to the Seller Representative before any items will be released to the buyer. NO EXCEPTIONS. 3. Buyer is responsible for all removal, and needs to contact Alex Cooper Auctioneers, Inc. about removal procedures. 4. If there is any issues buyer MUST contact Alex Cooper Auctioneers, Inc. prior to removal of any items, so the auctioneer can try to resolve any such issues.

Additional Check-Out Procedures. 1. Buyer is solely and fully responsible for removal of Buyer's lots. 2. Small Lot Removal - Alex Cooper Auctioneers, Inc. is not responsible for any missing or lost small lots if they have not been removed within 48 hours of the conclusion of the sale. There will be NO removal of any lots until the auction is complete. 3. It is solely the Buyer's responsibility to properly remove all fluids, oils, hazardous chemicals, etc., from machinery purchased at this auction. All oils should be properly stored in the appropriate containers (sealed drums). 4. Failure to remove all lots by the removal date results in Buyer's violation of the terms of the auction sale, providing Alex Cooper Auctioneers, Inc. with the right to exercise any options. Buyer will be solely responsible for all costs of these options. NOTE: Buyer is responsible for all rigging and removal of any lot. All removal is to be done by local and state code.

Records. The record of sale kept by the Auctioneer and bookkeeper will be taken as final in the event of any dispute.

Addition to or Withdrawal from Sale. Owners of the machinery have the right to add or remove lots as needed. If item has been paid for, a full refund will be given if lot is deemed not available anymore.
