Buyer?s premium of 13% in effect for this sale.
Previews will be held on the July 2nd & July 9th from 10:00am to 5:00pm
EST. We strongly recommend that you take the time to preview the
items and make your own determination as to the items value or fitness
prior to bidding. Also keep in mind pictures sometime don?t do items
justice including large quantities of items.

Everything is selling ?as is, where is? with absolutely no warranty of any
kind expressed, written or implied.

Everything must be paid for in full within 24 hours of the close of the
auction regardless of when you intend to pick your items up. Payment is
required in full prior to any removal.

We accept CASH, bank to bank wire transfer and business check only
with bank letter of guarantee. Any wire transfer must be completed
prior to removal. You agree to pay in full for any purchases according to
the terms and conditions requirements.

Kentucky Sales tax will be charged on those items not directly used in the
manufacturing process, i.e.?office furniture and equipment including
computers, phone system, refrigerators and numerous other non
manufacturing equipment and hardware. If you are tax exempt you will
need to present to us a copy of your exemption certificate and fill out
the required state form for our files. If you do not we will charge you
the full tax as required by law.

Buyers are responsible for their own shipping and removal of their items.

Removal of items will be on Thursday 12th thru Saturday 14th from
9:00am to 5:00pm EST and again on Monday 16th thru Wed 18th. The
auction company at their discretion may make available additional time
for removal of larger equipment. Because of lease issues time is
extremely limited but on larger equipment we will work with you riggers
if we can. Please call ahead of time with your requests. For major
equipment riggers must be used or you must provide proof of
$2,000,000 general business liability coverage along with a letter from
your agent declaring you are covered for the removal of items from the
Shively Wood Products Auction. You must also remove the equipment in
a professional workman like manner. Riggers can be approved by the
auction company if they have the necessary expertise and the
appropriate insurance in place.

We recommend that you remove any and all smalls early in the removal
period because you the buyer are solely responsible for these items
once the sale has concluded. The auctioneer or auction company is not
responsible for any theft, fire or any other disaster from which you may
suffer a loss from. We strongly recommend that you have in place the
appropriate insurance coverage to protect you in the event of such loss.

Any item or items not removed during the removal period will be
considered abandoned and the auction company may dispose of them in
any way they deem appropriate. Any expenses incurred in the items
disposal will be the responsibility of the buyer.

In the event of nonpayment by the buyer with one of the accepted
payment terms above, you authorize the auction company by accepting
the terms and conditions use of the credit card on file at the time of
your registration to pay for any and all items purchased by you plus an
additional five percent convenience fee. You also acknowledge that you
have full legal power to authorize and to bind the cardholder. You also
agree that you will pay for the auction purchase and indemnify and hold
the Auction Company harmless against any liability pursuant to this
authorization. Everything must be paid in full prior to removal.
International bidders will be required to place a deposit of 25% via bank to bank wire transfer of the amount they intend to bid, no exceptions.
