By making a bid, Bidder accepts the terms and conditions below and will be bound by them.
Auction Catalog is a guide only. Auction Company reserves the right to group lots, reduce or add quantity to lots, or delete lots.
Announcements made the day of the sale take precedence over written or advertised announcements, but do not alter, in any way, the terms and conditions of the sale.
For online bidders, a 2% Internet Fee capped at $750.00 per lot will be applied to all purchases. SD 4.5% Sales Tax applies to all purchases, unless either a valid resale dealers sales tax exception certificate is provided to the auction company, or qualification for a sales tax exemption is complied with in accordance with SD Dept. of Revenue regulations and SD law. Dealers who purchase for resale must file their resale permit numbers. If sales tax is not collected at the time of sale and is deemed applicable, the buyer agrees to pay all required taxes.
All purchases must be paid in full within 48 hours of the sale. After an item has been sold, it becomes the sole responsibility of the purchaser. Purchases will not be released until invoice is paid in full. All items must be removed on or before November 4, 2016.
Acceptable forms of payment include Cash, Wire Transfer, Cashier's Check, Personal or Company Check - ONLY when accompanied by a Bank Letter of Guarantee.
Auction Company makes every effort to accurately describe all items, but there is the possibility of error. Auction Company IS NOT responsible for any errors or omissions in the description of the merchandise.
Please inspect all items before bidding. Auction Company makes no warranty, expressed or implied. It is the Bidder's responsibility to determine condition, age, genuineness, value or any other determinative factor of items for sale.
Some items may have minimums or reserves. Therefore, bidder acknowledges they have been informed that Auctioneer may bid at the auction for its own account or on behalf of a third party or the seller.
Purchaser does hereby indemnify and hold harmless auctioneer and seller from any and all damages, claims or liabilities from injuries to persons or property of any type whatsoever caused during the sale or by the removal of items purchased.

All sales are FINAL. All goods are sold "AS IS" and "WHERE IS."
