At any time prior to the start of the auction, during the auction or following the auction, the Auctioneer may charge to the registrant's credit card a deposit of Cdn. $500, $1000 or 100% of the aggregate purchase amount. In the event such deposit is attempted prior to or during the auction and the registrant`s credit card is declined for such deposit, the registrant will be refused bidding privileges.
Should the on-line bidder be unsuccessful in making a purchase, the full amount taken as a deposit will be credited forthwith to the registrant`s credit card.
If for any reason, the auctioneer is unable to contact the purchaser following the auction, the auctioneer may at his own discretion, charge to the purchaser`s credit card a deposit amount or the full amount of the aggregate purchase amount plus taxes and buyers premium.
For credit card payments over $10,000, each buyer, following the auction, must complete a document including written signature, authorizing payment. Removal of purchases will be allowed only after Joiner has received endorsed document.

Foreign or out of province buyers will be provided forms that can be sent to the appropriate Government authority for a refund of pertinent taxes.
REMOVAL:
All items must be removed by 5PM, Mon., Feb., 17th, 2014 unless other arrangements are made with the auctioneer. Joiner Sales will be on site daily as needed, to facilitate removal. Joiner Sales Corp will provide names of removal contractors as available and will co-operate to facilitate removal by the purchaser or agent. Cost and responsibility of removal remains with the purchaser.
No removal prior to payment in full. Purchaser shall be liable for any rent incurred or damages suffered by Joiner Sales Corp in the event that the purchaser fails to remove purchase(s)within time allotted or by damaging the premises during removal.
Purchaser or agent may be required to provide proof of adequate insurance prior to removing lots requiring dismantling, rigging or hot cutting.

Subject to amendments and modifications announced by the Auctioneer at the time of the auction, all persons participating in the auction shall be bound by the following terms and conditions and as stated or otherwise set forth in the mail-out brochure, lot listing catalogue, notices in the foregoing and/or on the Auctioneer's website www.joinersales.com.
1. Absolutely no warranty or representation, written or oral, is given with any lot. All statements contained in the Joiner catalogue, website, marketing material or by the auctioneers, or in any bill of sale, invoice or elsewhere as to description, size, quantity, quality, capacity, model, serial number, measurements or condition, are approximated statements and shall not be deemed to be representations or warranties, oral or written, with respect to any lot. No sale is invalid or made void by reason of any flaw in a lot or by reason of a lot being incorrectly described, and Joiner will not be liable and no compensation will be paid for any such fault or error of description.
2. All Articles will be sold to the highest bidder conforming to the bid process, provided that the Auctioneer reserves the right to sell articles by individual, group lots and in bulk, as he deems appropriate. Joiner reserves the right to sell on behalf of third parties, its own account or on the account of others. Should any dispute arise between two or more bidders or as to any bid, the lot in question may, at the Auctioneer`s discretion, be immediately put up again and resold. The Auctioneer shall regulate all matters relating to the conduct of the auction and his decision shall be final and binding on all bidders. If any dispute arises after the sale, the Joiner sales record shall be conclusive in all respects.
3. All sales are final, on an "as is where is," in place with all faults basis ,with no conditions or warranties whether expressed or implied, statutory or otherwise, including without limitation, warranties or conditions, as to title, description, fitness for purpose, quantity, quality, merchantability, state, condition, location or otherwise. No sale shall be invalidated and the auctioneer shall have no liability for an error in description of any article or lot whether contained in a catalogue, advertisement, website or otherwise. Absolutely NO RETURN of sold goods, NO REFUNDS, and NO EXCHANGES will be permitted. Descriptions have been prepared for guide purposes only and shall not be relied upon by the purchaser for accuracy or completeness. Please inspect all items before bidding. Purchasers shall be deemed to have relied entirely upon their own inspections and investigations.
4. All sales shall be concluded as indicated by the Auctioneer and no Purchaser may thereafter revoke their bid. Title to the lots purchased shall not pass until payment in full of the purchase price is received.
5. Each successful online bidder will receive confirmation on the day of sale either by phone or by e-mail. All purchases must be paid in full on the day of sale. Joiner will charge to the buyer’s credit card the full price of the winning bid price, buyers’ premium and applicable taxes. Should the buyer wish to pay by other means the charges placed on the buyer’s credit card will be refunded in full once such equal monies are received by Joiner.
6. Purchase of any lot is at the Purchaser’s risk with risk of loss immediately passing to Purchaser upon the auctioneer’s acceptance of final bid. Neither Joiner nor its consignors, have any liability of any nature whatsoever to Purchaser if the lot is not delivered to Purchaser due to fire, theft, damage, or any other cause. If Joiner or its consignor is unable to deliver any lot or any necessary documentation required in respect of any lot, their sole and exclusive liability shall be the return of any monies paid on such lot in respect of the article and the Auctioneer shall have no further liability to the Purchaser arising from or relating to such loss, including without limitation, any damages or loss of profits.
7. The Auctioneer reserves the right to refuse any applicant the privilege of bidding, participating or attending the auction and may revoke such privilege at any time.
8. A Buyer's Premium as posted on our website or announced, will apply at this sale
9. No Purchasers may assign, transfer or dispose of their rights in any article purchased before they have paid the purchase price in full. Notwithstanding, these terms and conditions shall continue to be in effect and automatically transferred to any assignee or transferee
10. Where available, documents of transfer, including motor vehicle ownership documents, which are in possession of the Auctioneer, will be provided to the Purchaser following the auction or as soon thereafter as such documents become available.
11. Bidders acknowledge that any auction site is a potentially dangerous place with noxious, corrosive and pressurized substances being present, heavy equipment being operated and electric circuits being live. Every person at the Auction Site before, during and after the auction sale shall be deemed to be there at their own risk with notice of the condition of the premises, the activities on the premises and the conduct of third parties, and the Bidder shall so advise his/her agents and employees. No person shall have any claim against the auctioneer, his agents, employees or principals for any injuries sustained for damages to or loss of property which may occur from any cause whatsoever.
12. No article shall be removed unless paid for in full and all articles purchased shall be removed within the guidelines, deadlines and terms stipulated. The Purchaser shall be responsible for all costs of removal and shall be liable for any damages, including without limitation, any environmental damage, caused during or as a result of the removal. Purchasers shall comply with all environmental laws and regulations and all requirements established by the Auctioneer for the removal of articles, including providing proper insurance and which Riggers may operate on site; please refer to the "REMOVAL PROCEDURES" below.
13. Time shall be of the essence. Title will revert to seller in the event Purchaser does not remove their purchase by the time specified. If a Purchaser fails to make payment or remove goods within the time periods herein above provided, the Auctioneer may resell the article purchased by auction, private contract or otherwise, as the Auctioneer in his discretion deems advisable. If the Auctioneer makes a good faith attempt to resell the article but cannot, he may dispose or scrap the article. The Purchaser shall be liable for the shortfall and all costs and expenses incurred in such resale or scrapping, as described in the foregoing. These costs and expenses include, but are not limited to, attorney fees, court costs, law enforcement costs, moving and storage costs, and any other commissions incurred or fees assessed by the Auctioneer. Attorney fees and costs include, but are not limited to, such fees and costs incurred in the pursuit of a claim, judgment or a citation against the Purchaser(s) and/or any Guarantor(s).
EQUIPMENT REMOVAL PROCEDURES/ TERMS & CONDITIONS
Buyers are responsible for, at their expense:
(a) proper and safe disconnection and termination of all electrical, gas, water and/or air lines to machines as instructed or directed by an authorized Joiner representative;
(b) shearing flush to the floor of all anchor bolts or fasteners;
(c) repair, in a first class, proper workmanlike manner, all holes in the floor or roof created by the removal of items purchased;
(d) removing, off premises, all hazardous materials (including all contaminants) contained in items purchased;
(e) repairing, in a first class, proper workmanlike manner, all damage caused to the premises by a buyer, its representative or any other party hired by a buyer for the removal of items purchased;
(f) leaving the work area in a clean, broom-swept condition;
(g) any other specific terms and conditions communicated by Joiner before, during or after the auction sale;
(h) removal of items purchased by the time and date set by Joiner before, during or after the auction sale; and
(i) the safety of all of a buyer`s employees, agents or representatives including all movers/riggers hired by such buyer.
Buyers and their movers/riggers are jointly and severally liable for all damages, costs and expenses to the premises or any other assets which were caused by any of them, their employees, agents or representatives whether through negligence or otherwise. The Buyer indemnifies and saves Joiner harmless from any and all costs, expenses and claims suffered or incurred by Joiner as a result of any act or omission of such buyer and/or any mover or rigger retained by a buyer.
