Nevertheless, neither those descriptions nor any oral statement made by the owner (or his agents or officers) or by the Auctioneers (or his agents or officers) concerning any item shall be construed as a warranty, either expressed or implied. I, bidder have examined this merchandise and accept it the way it is. All mileage, hour meters, & Description on vehicles and equipment are not guaranteed by auction company or any of its representatives.Auction company HIGHLY suggested contacting an auction representative prior to auction for further pictures, videos, or information on trucks and equipment!! DISPUTES: The Auctioneers shall designate the winning bidder after each item is auctioned off. If a dispute arises between two or more bidders, the Auctioneers reserve the right to reopen the bidding. The Auctioneers designation of a buyer shall be final. BINDING ARBITRATION: The Parties agree that in the exclusive course of action an any litigation or dispute concerning the enforcement of this agreement shall be by binding arbitration within County of Adams, State of Indiana and the Indiana laws shall govern. INJURY AND DAMAGE AND HOLD HARMLESS: Bidder acknowledges responsibility for any Personal injury property damage caused by bidder or his agent, and further agrees to hold auctioneers and owner harmless for any and all personal injury to himself or his agents and any property damage incurred on auction premises. Buyer agrees to hold auctioneers and owner, their agents or employees, harmless from any and all suits, claims damages, cost and expenses of every kind and nature which may or might be asserted against the auctioneer or owner, their agents or employees, resulting from the actions or inaction of buyer. Buyer agrees and understands that by law employers are required to carry workers compensation coverage for its employees. Buyer is responsible for the providing of worker’s compensation, liability and property damage insurance as respects their property and contractual obligation. Title Info: $35 Title processing fee PER TITLED ITEM. Most Titles will not be sent out within 14 days after auctions, Some titles could take up to 30-45 Days. Krueckeberg Auction & Realty and or the sellers will not issue duplicate titles once titles are in buyers possession. Buyer's Premium PER ITEM: 12% up to $5,000, 9% $5,001 up to $15,000, 7% $15,001 up to $40,000 and 5% $40,001 and up.
