Terms and Conditions

Bidder agrees to comply with these Terms & Conditions as a prerequisite for the Land of Land (“Auctioneer”) to accept the Bidder's Registration and to issue a Bidder Number. 

The Payment Due will the final 'hammer' price plus, per Auction Lot won, the auction premium (8.5%) and a $695 documentation/processing fee.  Payment Due in full within 48 hours from the conclusion of the auction.

 

Wire transfer is the preferred method of payment.  If Auctioneer agrees to accept a payment via credit card, a 3% credit card fee may be assessed.  

 

Bidder agrees that insufficient available funds to pay the full Payment Due shall not be a valid defense for non-payment.  An Auction Lot that calls for financing will require the Bidder to enter into an agreement with complete terms and conditions.  

 

If the Payment Due is not received within 48 hours after the conclusion of the auction, the bidder unconditionally authorizes the Auctioneer to charge any credit card on file for the amount due.

Bidder authorizes the Auctioneer to send text messages to Bidder’s mobile phone.

 

IF A WINNING BIDDER FAILS TO MAKE THE PAYMENT DUE IN THE STIPULATED TIMEFRAME, BIDDER CONSENTS TO GRANT TO AUCTIONEER ONE-THIRD OF THE PAYMENT DUE AS LIQUIDATED DAMAGES OR SPECIFIC ENFORCEMENT, PLUS 150% OF AUCTIONEER’S LEGAL AND COLLECTION COSTS. 

UNLESS OTHERWISE SPECIFIED, TAXES OR FEES WHICH MAY BE OWED ON ANY PROPERTY IN THE AUCTION ARE THE RESPONSIBILITY OF THE BUYER.


ALL PROPERTIES ARE SOLD IN 'AS IS' CONDITION WITH ALL FAULTS AND DEFECTS WITHOUT WARRANTY OR GUARANTEE OF ANY KIND.  AUCTIONEER MAKES NO REPRESENTATION AS TO THE FITNESS OF ANY PARCEL FOR A PARTICULAR USE.

TRANSFER OF OWNERSHIP. Properties are conveyed by recorded deeds without title insurance,  unless requested in advance of the auction by Bidder and agreed to by Auctioneer, the cost of which is borne by Bidder. Bidder authorizes Auctioneer to act as
Bidder’s agent to complete any closing documents or any corrective documents thereafter. 

 

Bidder must provide to the Auctioneer the following Deed Information for each Lot: the name of the Grantee and the address for the Grantee. If Bidder fails to provide Deed Information within two weeks
after payment of the Payment Due, Bidder authorizes Auctioneer to convey each Lot via deed using the Bidder’s name and address as registered in the auction. 

 

NO CREDIT CARD CHARGEBACKS: Each Bidder agrees to NOT, under any circumstances, initiate a credit card chargeback with respect to any charges.   
Bidder further agrees that if Bidder initiates a credit card chargeback, upon Auctioneer’s demand, (1) Bidder shall withdraw such credit card chargeback and request the credit card issuerto re-credit all amounts to the account of the Auctioneer; and (2)Bidder shall be responsible for all costs and expenses, including but not limited to any attorney fees incurred by or on behalf of the Auctioneer, in challenging the credit card chargeback.



BIDDER’S RESPONSIBILITY: Each bid is an irrevocable offer to purchase the assets included in the Auction Lot. Bidders are responsible for all bids made using the Bidder’s account and Bidder Number.  If Bidder believes that an unauthorized person has placed a bid on the Bidder’s account, Bidder must notify the Auctioneer immediately by sending an e-mail to info@landofland.com. Bidders must also promptly report the incident to the relevant law enforcement authorities and send the Auctioneer a copy of any resulting police report; otherwise, Bidder will be held personally responsible for all purchases.

 

BIDDER CONSENTS TO EXCLUSIVE JURISDICTION IN THE STATE COURTS OF NEW JERSEY OR BINDING ARBITRATION AT AUCTIONEER’S OPTION AND AT BIDDER'S EXPENSE.  BIDDER WAIVES ANY JURISDICTIONAL DEFENSES TO ANY SUIT FILED IN THE STATE OF NEW JERSEY.
