 Please call Art Nichols 843-860-1067 for instructions on pick up; this is a locked facility and you MUST have a scheduled time/date. All Items are to be removed by 3/15/24. If Items have NOT been removed, they will be moved to another location at buyer's expense. ALL CRANES MUST BE BROKEN DOWN BY THE BUYER, WE WILL NOT HAVE SUPPORT TO BREAK THEM DOWN. 

TERMS & CONDITIONS

• Payment – Cash, Credit Card, Wire, ACH or Check approved by Art Nichols.
• Sales Tax – Added to the purchase price of all taxable items. You must provide a resale certificate or TAX EXEMPTION if you are tax exempt.
• Warranty – All items sold As-Is, Where-Is, with no warranties or guarantees expressed or implied on any items. No deduction will be allowed on damaged articles as all goods being exposed for public exhibition are sold “as is” and without recourse. Buyer shall rely on their own inspection & information.
• You must be a registered bidder to bid. Nichols Equipment Inc., Auction Division reserves the right to refuse the registration of any person who does not comply with registration guidelines.
• Removal – All items must be paid in full before item can be removed from the property. Removal shall be at the expense, liability, and risk of the purchaser.
• Staff Bidding – If you see on of our staff bidding, it is not to run the bid up. It is because they want the item themselves. They are also a registered bidder.
• Reserved Bids – We do have some reserved bids. We want to sell all items. The auctioneer reserves the right to reject any or all bids. He has the right to refuse a bid, to divide any lot or lots from the sale whenever the best interest of the seller will be served
• Absentee Bidding– We have a few absentee bids.
• Security – We do have security onsite. You must show your paid receipt before you can leave with any item.
• All announcements from the Auctioneer take precedence over all other printed material.
• Dispute Between Bidders – If any dispute arises between two or more bidders, the decision of the auctioneer shall be final and absolute.
• Personal & Property Risk – Persons attending sale assume all risk of damage of or loss to person and property and specifically release auctioneer and auction company from liability therefore. Neither auctioneer nor auction company shall be liable by reason of any defect in or conditions of the premises on which the sale is held.
• Every effort is made to “guard” merchandise throughout the auction; however, the bidder becomes solely responsible for all items purchased by him immediately following his winning bid. Therefore, he/she is advised to further guard his/her items at his/her own discretion.
• The Bidder is responsible for knowing which item he/she is bidding on. If he/she is unsure, he/she should inquire or not bid. When you become the winning bidder at auction you have effected a contract and will be expected to pay for items in which you were evidenced to be the successful bidder. Auctioneer will not honor “mistakes”.
• The Auctioneer reserves the right to accept bids in any increment he feels is in the best interest of his client the seller. The Auctioneer reserves the right to reject the bidding of any person whose conduct, actions, or adverse comments he feels are not in the best interest of the seller.
• Buyer’s Premium – As follows when paying: 15% on each item if purchasing online; 10% if on the ground
