IMPORTANT INFORMATION:
1. ALL Pickup Times will be scheduled with our office personnel. Pickup date and time: Friday, December 1st, 9:00 a.m. – 4:30 p.m., by appointment only. All payments must be confirmed within 48 hrs of auction closing, by Wednesday, December 4th by 12:00 PM, NO EXCEPTIONS.
Bidders paying with cash or cashiers check will need to pay at the Fort Wayne, IN 46809 location, by 12:00 PM, Wednesday, December 4th.
2. Scheerer McCulloch Auctioneers, Inc. will only accept the following types of payment: cash, cashier’s check, wire transfer, or ACH. The following Buyer’s Premium rates will apply to this auction 18% Buyer’s Premium applies to all purchases. NO SALES TAX.
3. The Buyer must present the PAID in FULL invoice to the Auctioneer’s staff prior to removal of any item.
4. Winning bidder must notify Scheerer McCulloch if arranging someone else to pickup purchases on your behalf. Notification must be submitted in writing, picker will be verified with a valid Driver's License.
5. Winning bidder must bring your own assistance to help move and load items, auction staff will NOT assist in lifting or moving items.
6. Winning bidder must arrive prepared with any necessary tools (dollies, hand trucks, protective gear-as needed), etc).
7. Removal is at the expense, risk and liability of the purchaser. Purchases will be released only upon presentation of PAID IN FULL invoice. The Auctioneer will not be responsible for items not removed within the time allowed.

3.***INDEMNIFICATION: Purchaser shall defend and indemnify and hold auctioneer and seller harmless from and against all claims and liabilities relating to the condition of, removal of, or use of the articles purchased or failure of user to follow instructions, warnings or recommendations of the manufacturer, or to comply with federal, state, and local laws applicable to such articles, including OSHA requirements and Environmental Protection Agency requirements, or for proximate or consequential damages, costs or legal expenses arising there from.
4.***RESPONSIBILITY FOR ARTICLES: At the time each article is sold, ownership of and responsibility for that article is transferred immediately to winning bidder. After articles are removed from auction location or the announced removal period has ended, the auctioneer and the seller will have no obligation to the winning bidder and no responsibility for articles sold. Bidders are responsible for inspecting each article sold before it is removed from site.
5.***ACCEPTANCE OF TERMS AND CONDITIONS: Any and all bids made by any and all bidders are legally binding contracts to purchase articles for the price offered according to the terms and conditions listed herein. In the event that a winning bidder does not perform within the terms of this contract, the auctioneer may, in addition to all other remedies allowed by law, retain all monies received as deposit or otherwise as liquidated damages. Articles not paid for and removed within the announced payment and removal times may be resold at public or private sale without further notice, with no reserve; any deficiency, together with all expenses and charges of resale, including legal fees, will be charged to the defaulting purchaser.
6.***BIDDING on any item indicates your acceptance of these terms and all other terms announced at the time of sale.
7. It is the buyers’ responsibility to secure all safety equipment to meet all applicable government safety standards in using or removing items purchased.
8. ITEM REMOVAL/PICKUP: Removal shall be at the expense, liability, and risk of the purchaser. Buyer is responsible for all tools and labor required for the safe removal of their items. This includes the safe disconnection, dismantling, moving and removing of the items within the specified times and dates. Purchases will only be released upon presentation of a Paid Receipt and under the supervision of a SMA Auction Team Member. For their safety, minors will not be allowed in the area where items are being moved, dismantled, disconnected and removed.
9. ALL SALES ARE FINAL.
