All buyers need to furnish all resale certificates and Texas resale exemption forms if dealers. All out of state buyers who are not dealers must furnish bills of lading from a common carrier to not be charged sales tax. All export buyers must furnish dock receipts and bills of lading to not pay sales tax. The State of Texas will issue Farm Exemption Numbers for Farm Exemption for residents of Texas. 8.25% sales tax. THIS CATALOG IS MEANT MERELY AS A GUIDE WITH NO WARRANTIES OR GUARANTIES EXPRESSED OR IMPLIED. ALL ANNOUNCEMENTS BY THE AUCTIONEER SHALL SUPERSEDE ANY PRINTED MATERIAL. LOAD OUT Security will not allow the removal of purchases without a release ticket. The office will assist you with release tickets for your transportation company on the items purchased at this auction. All items for this sale must be removed from the facility by November 30, 2024. Extended load out terms can be negotiated separately with the landlord at the conclusion of the auction. Any items that are abandoned at the conclusion of the load out period will be removed by the seller and the cost of that removal will be the responsibility of the buyer. Buyer will be responsible for meeting insurance requirements for all parties removing items on their behalf. The auctioneer can provide these requirements upon request prior to sale. For all lots that are unanchored to the floor or walls, all floor and wall surfaces must be left in the condition they were in prior to load out. For all lots that are attached to walls or floors, or those components of which that are buried, the buyer will be responsible for backfilling and smoothing floor surfaces to the same condition as all contiguous floor surfaces. For all units removed from the ceiling, the buyer will be responsible for capping all holes created from the removal. BUYERS RESPONSIBILITIES All descriptions are made in good faith, but it is the buyer's sole responsibility to inspect items. Items become the sole responsibility and property of the purchaser when auctioneer completes the sale of the item when the bid is accepted by the auctioneer. Possession will be obtained upon proper settlement. Purchaser will be responsible for the removal, insurance, breakdown, arranging, shifting, loading, and securing of load for any items purchased. SITE Auction Services does not arrange or contract freight for buyer's items unless agreed upon by both parties. It is the buyer's responsibility to have inspected the item and determined the condition, year, model, serial number and mileage of the item from their inspection. All persons in attendance at this auction must be an adult. No one under 18 will be allowed on auction premises without adult supervision. No minors are permitted to bid in any auction. SITE Auction Services is providing internet pre-auction and live bidding as a service to Bidder. Bidder acknowledges and understands that this service may or may not function correctly the day of the auction. Under no circumstances shall Bidder have any kind of claim against SITE Auction Services or anyone else if the internet service fails to work correctly before or during the live auction. SITE Auction Services will not be responsible for any missed bids from any source. Internet bidders who desire to make certain their bid is acknowledged should use the proxy-bidding feature and leave their maximum bid 24 hours before the auction concludes. SITE Auction Services reserves the right to withdraw or re-catalog items in this auction.SITE Auction Services reserves the right to refuse a bid at any time. Local pickup at item location as specified in item description. Exact location and pick up contact will be provided upon receipt of payment. Buyer must contact auctioneer if they need items shipped. All items shipped by auctioneer will incur an additional fee for packing and shipping materials and/or logistics service. Auctioneer will not ship items directly unless agreed upon by both parties. Auctioneer is not obligated to ship any items. Site will be made available to buyer upon proper settlement. The buyers will have access on weekdays, weekends, and at all hours of the day, with an appointment by the auctioneer for all after hours or overnight rigging, tear-down, or loading. All lots must be removed in their entirety by November 30, 2024. Any items remaining after that will be removed by the seller and the buyer will be responsible for any costs incurred for that removal. Additional removal time may be negotiated separately with the landlord at the conclusion of the auction or during the load-out period. Any dispute must be adjudicated in Montgomery County, TX.
