Payment - Your credit card will be processed for the full amount of sale immediately following close of the auction *unless PRIOR alternative payment arrangements have been made with Thomas Hirchak Company known as “THCo”. Credit card payments will have 3% added to invoice for processing fees.

Every effort will be made to ensure that each item stays in the same condition that it was photographed in. It is important to note that all property is sold “as is, where is" and all sales are final.

AUCTION LOAD OUT DETAILS:

LOADING DOCKS: 2 Dock Height Loading Docks, 1 Ground Level Loading Dock

EQUIPMENT AVAILABLE: There will be 2 Forklifts available to help Place any palletized items on a truck trailers, they will be loaded to the end of the Trailer,(it is the responsibility of the buyer/transporter to have a Pallet Jack available to move the items from the end of the trailer)

TRANSPORTERS: It is the responsibility of the buyer/transporter to pack and palletize the lots themselves, many lots are partial pallets and are not ready for transport, Transporters will also be responsible to have a pallet jack available to move items from the end of the trailer.

PALLETIZING: * If you need Thomas Hirchak Company to Palletize any items, There is a $75.00 Palletizing Fee, Per Pallet. This must be set up in advanced by Noon EST Friday, September 12, 2025 (CALL 802-888-4662).

PALLETIZING PICK UP: Lots that require additional palletizing by Thomas Hirchak Company can not be picked up until 12PM Day 3 of Load Out. Wednesday, September 17, 2025. (* Palletizing is NOT Available for any items that say it is the Responsibility of the Buyer to Remove) No Exceptions!

RIGGING: BUYERS ARE RESPONSIBLE FOR CONTACTING THEIR OWN RIGGER OR RIGGING THEIR OWN LOTS FOR THE SCHEDULED LOAD OUT!

ADDITIONAL FEES: ** Fees will be incurred for any attempt to pick up AFTER the scheduled load out. *Minimum of $500 for the First Hour, $100 per any additional hour. (Must be scheduled and fees paid with the Office in advance 802-888-4662). No Exceptions!

BEFORE PLACING A BID: It is important that you are familiar with the terms and conditions as all sales are final. The terms of sale are non-negotiable. Buyer is responsible for all costs and fees associated with purchase and removal of items - no refunds. THE SALE WILL BE CONTROLLED BY THE AUCTIONEER PROGRAM: Thomas Hirchak Company is not responsible for malfunctions or system errors which cause a bid or bidder to fail to be recognized or registered. If there is a dispute, the Auctioneer may re-open the bidding at the Auctioneer's sole discretion and shall serve as the sole arbiter as to who is or is not allowed to bid. ITEMS SOLD AS IS, WHERE IS: Thomas Hirchak Company has made every attempt to fully disclose any known condition of product being sold. Auction items are sold 'AS IS, WHERE IS' with no financing, inspection or other contingencies to sale. Buyers are responsible for conducting their own due diligence and investigation of each auction prior to making a bid and purchase at the auction. Buyers must rely solely upon their own investigation and not any information provided by the Seller or Auctioneer. Failure of a Buyer to be fully informed on the condition of an item will not constitute grounds for any claim adjustment or right to cancel sale. PICK UP OF ITEMS: Item(s) MUST be completely removed from auction site on specified day. Please bring appropriate means to load and haul your items including but not limited to boxes, packing material, any necessary tools, ladders, or other equipment involved with the disassembly or removal of items. Any items not picked up on the specified day will be considered 'ABANDONED'. Buyers that do not show up for scheduled load outs and do not communicate with THCo will have all winning lots considered, 'ABANDONED WITHOUT REFUND.' Buyers must make any transport requests 24 hours prior to auction closing email helpdesk@THCAuction only. Buyers may not make transport arrangements with any other THCo staff. Transport fees are at minimum $50 per Lot regardless of invoice total. THCo reserves the right to refuse transport of any items. Items may only be transported back to THCo Morrisville and must be retrieved by buyer within 48 hours or 2 business days. Items not retrieved within 48 hours are considered, 'ABANDONED WITHOUT REFUND.' No exceptions. Alternative Pickup: Vehicles & Heavy Equipment, Located at OUR facility ONLY: ALL alternate arrangements must be requested and agreed on prior to bidding (not after item has been won, not all items are able to have an Alternate pick up day). If failure to pick up on the agreed alternate day, Thomas Hirchak Company will charge a storage fee of $20 per day. (Pick up day must be approved by THCo and must be during business hours, Monday - Thursday 8AM - 4PM). RESERVES, EXTENTIONS & CANCELATION: Auctioneers reserve the right to either lift reserve prices or introduce reserve prices. If you are the high bidder on a lot when a reserve is lifted and are not outbid, you are obligated to purchase the lot. If you are unclear on this, please do not bid. In circumstances deemed necessary, the auction may be postponed to a later date, or if needed, the auctioneers reserve the right to cancel the auction entirely. In addition, the auctioneers have the prerogative to extend the auction beyond its initially scheduled conclusion and may exercise their discretion to undertake any other essential actions to ensure the smooth and equitable conduct of the auction process. JEWELRY, WATCHES or PRECIOUS METALS: As a preventative measure against buyer fraud, Thomas Hirchak Company may hold items up to 30 days to insure clear payment. VEHICLES are sold 'AS IS, WHERE IS.' We do not confirm that a vehicle is mechanically sound. Miles/Hours and year are not guaranteed. We adhere to Vermont laws. All vehicles 15 years or newer will be sold with a title. ** It is the buyers responsibility to know the title requirements of your State. Please review your State requirement when transferring ownership of a vehicle. 'Runs & Drives' means the vehicle starts and moves. 'DNR' indicates the vehicle does not run. 'Title Available' means we have the title, and it is available. 'Prior Vermont Registration Available' means we have the prior Vermont registration and will sign it over. 'Vermont Bill of Sale Only' means the vehicle will be sold with a bill of sale. We do not have additional documentation and cannot obtain additional documentation for the vehicle. It is the buyer’s responsibility to inspect the vehicle prior to purchase.
