This is an ONLINE ONLY AUCTION- PLEASE DO NOT BID IF YOU ARE NOT ABLE TO PAY FOR, PICK UP OR ARRANGE SHIPPING FOR YOUR ITEMS during the scheduled removal times. NO refunds or chargeback's will be granted due condition or non working status of equipment or a lack of removal at the designated times. After the scheduled removal, items will be considered abandoned and you will be charged a removal fee to dispose of your items. We do not pack and ship but have listed options in the removal section. because all equipment came from a third party and auctionexcess does not work on or imply working condition or complete condition with all functioning parts included we highly recomend inpection of all lots before bidding. please feel free to call us with futher phsical details of pictures as we would be happy to provide them for you.  

PAYMENT: ALL INVOICES MUST BE PAID IN FULL WITHIN 24 HOURS AFTER CLOSE OF AUCTION. Payment is to be made to Auction Excess LLC. Accepted forms of payment include Cash, Certified Check, Bank Wire, Visa and MasterCard payment through our PayPal portal. You must have available balance on your credit card for your purchases. NO business or personal checks will be accepted.  All purchases over $5000 MUST be paid via wire transfer.  All International Purchases must be paid for via wire transfer. At the conclusion of the auction, an invoice will be emailed (check your spam box, it is your responsibility to check your emails) to you AFTER the auction closes and you will need to notify us how you would like to pay the balance of your purchases.  Call within 24 hours to schedule payment: 818-626-9705. No merchandise will be released until invoice is paid in full. 

BUYERS PREMIUM:  An 18% buyer’s premium will be added to each purchase if paid via Visa or Master Card.  If your winning bid was $100.00 your final purchase price will be $118.00.  A cash discount amounting to a 15% buyer’s premium will be added to each purchase if paid via cash, certified check or bank wire. If your winning bid is $100.00 your final purchase price will be $115.00 

REMOVAL: Schedule your removal appointment.  We are closed Saturday and Sunday. For clients requiring purchases to be packed and shipped you may contact any vendor of your choice, please have them call ahead to schedule a pick up time. Increasing your own bid/Bidding Errors 

Please be aware that many bidders routinely increase their own bid to price an item out of reach of other bidders. You should immediately review your bids once submitted. If you mistakenly increase your own bid, place your bidder number in the bid field, or make a typo you must immediately contact Bidspotter at 253-858-6777. We will not reverse bids after the auction has closed no exceptions.

 

Staggered Closing: The online auction closes up to several items per minute. This feature will close the bidding on intervals. This feature works great with the auto-extend feature to closely emulate a 'live' auction.

 

Dynamic Closing. The closing time of an asset is automatically reset to 10 minutes whenever a bid is placed within the last 10 minutes of the asset's closing time.

 

Bid Notification: If you have been outbid you will be notified by email ONLY UNTIL the last day of the auction. Starting at midnight EST the night before the ending of the auction notices are not sent. To quickly review your bids and see if you have won you can utilize the 'review bids' feature. Items that they have been outbid on will be clearly marked

 

Winning Bidder Notification: You will be contacted by email ONLY (you are responsible for checking your email) If you feel you have won an item and have not received an email you must notify us by email no later than 6pm the next day. If you do not receive an email invoice then you did not win any items at the online auction.

 

SALES TAX: Sales tax will be collected based on current VENTURA COUNTY.  Sales tax is added to the final purchase price, this includes your buyer’s premium. If you are buying for resale please notify us and send in a signed resale form AFTER YOU RECEIVE YOUR INVOICE.  If your purchases are being shipped out of state by a common freight carrier, sales tax will be waived and an airbill/tracking documents must be on file with Auction Excess.

CONDITION OF ARTICLES SOLD:  Neither the auctioneer nor the seller shall be responsible for the correct description, genuineness, authenticity of, or defect in any lot, and makes no warranty in connection therewith. No sale shall be set aside nor allowance made on account of any incorrectness, error in cataloging, or any imperfection not noted.  NO DEDUCTION ALLOWED ON DAMAGED ARTICLES, ALL ARTICLES BEING EXPOSED FOR PUBLIC EXHIBITION, AND SOLD "AS IS" AND “WHERE IS” AND “WITH ALL FAULTS” AND WITHOUT RECOURSE.  ARTICLES ARE NOT WARRANTED AS MERCHANTABLE OR FIT FOR ANY PARTICULAR PURPOSE.  NO CLAIM MAY BE MADE BY PURCHASER RELATING TO THE CONDITION OR USE OF ARTICLES PURCHASED OR FOR PROXIMATE OR CONSEQUENTIAL DAMAGES ARISING THEREFROM.  Bid accordingly: there will be NO REFUNDS and NO EXCHANGES

 

CAUTION: For demonstration purposes multiple pieces of equipment may be combined. Do not assume a lot consists of more than one item simply because they are connected or pictured together. Please inspect the lot numbers and read the descriptions.

 

Bidders are responsible for their own removal. Any item NOT picked up by the set time will be considered abandoned. Removal shall be at the expense, liability, and risk of the purchaser. Purchases will be released upon presentation of a paid email receipt. Please insure that movers or anyone picking up items on your behalf have your paid receipt at the pickup location no items will be released without a paid email receipt. Bidder further agrees to be held personally responsible for all purchases made on their bidder number, and agrees that bidder will not charge-back items which are not picked up during the published removal times.

 

Damage: Any damage caused by a buyer during the preview, or during the period of removal must be made good by the buyer causing the damage. Buyer agrees that the credit card on file will be charged for any expenses and/or repairs to the pick-up location or property of another buyer.

 

IMPORTANT! The Auctioneer will have the option of reselling, removing, storing or abandoning, at the expense and risk of the buyer for items not paid for and/or removed within the specific time. The buyer agrees to pay all deficiencies, legal, collection; transportation and storage expenses associated with delinquent accounts or abandoned items. Owner reserves the right to bid.

 

CHOOSE WISELY: We want everyone to be satisfied with their purchase. However, when you bid on the wrong item or decide an item is not suited for your intended use, our clients are not willing to assume the cost of your mistakes. When in doubt about condition, completeness or suitability for intended use, please bid accordingly.

 

The auctioneer reserves the right to add or remove items form the auction, split or combine lots, add minimum bids or reserve prices, cancel, suspend, extend or reschedule an individual item and or auction event or make changes to the auction closing times or inspection or removal times.

 

 

 

INDEMNIFICATION:  Purchaser shall defend, indemnify and hold auctioneer and seller harmless from and against all claims and liabilities relating to the condition of, removal of, or use of the articles purchased or failure of user to follow instructions, warnings or recommendations of the manufacturer, or to comply with federal, state, and local laws applicable to such articles, including OSHA and Environmental Protection Agency requirements, or for proximate or consequential damages, costs or legal expenses arising therefrom.

 

CLAIMS:  NO CLAIMS WILL BE ALLOWED AFTER REMOVAL OF GOODS FROM THE PREMISES OR LEFT ON THE PREMISES PAST THE ALLOWED TIME LIMIT. Any controversy or claim arising out of or relating to this contract and/or agreement, or breach thereof, shall be settled by either Small Claims Court, State Court or arbitration in accordance with the Commercial Arbitration Rules of the American Arbitration Association, and judgments upon the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof. Venue will be Los Angeles County, California.

 

 

 

RESPONSIBILITY FOR NON-DELIVERY: Neither the auctioneer nor the seller, in any event, shall be liable for non-delivery or for any other matter or thing, to any purchaser of any lot, other than for the return to the purchaser of the deposit or sum paid on said lot, should the purchaser be entitled thereto.

 

 

 

COMPLIANCE WITH TERMS OF SALE:  In default of payment of bills in full within the time therein specified, the auctioneer in addition to all other remedies allowed by law, may retain all monies received as deposit or otherwise, as liquidated damages.  Lots not paid for and removed within the time allowed herein may be resold at public or private sale without further notice, and any deficiency, together with all expenses and charges of resale including legal fees, will be charged to the defaulting purchaser. In addition, the auctioneer has the right to notify Bidspotter that buyer defaulted on purchases which will be noted in buyers account and BANNED from future Auction Excess auctions.

 

RISK TO PERSON AND PROPERTY:  Persons attending during exhibition, sale or removal of goods assume all risks of damage of or loss to person and property and specifically release the auctioneer and seller from liability therefore.  Neither the auctioneer nor his principal shall be liable by reason of any defect in or condition of the premises on which the sale is held. Any damage caused by a buyer during the preview, or during the period of removal must be made good by the buyer causing the damage.

 

 CONTRACT MOVERS:  If purchaser wishes to hire or contract with a mover, rigger or other type of outside contractor, Auction Excess LLC will not allow them to work on these sale premises unless they have placed with the auctioneer proper insurance protecting Auction Excess LLC and our CLIENT/COMPANY that the auctioneers are conducting the sale for, against any and all claims arising from personal injury and/or property damage created by their actions.  This requirement is for the auctioneer's protection - NOT FOR THE PURCHASER'S therefore the auctioneer suggests that the purchaser review the insurance policies of the mover regarding the coverage that they have protecting the purchaser and damage or loss of the equipment they may be moving for the purchaser.

 

ADDITION TO OR WITHDRAWAL FROM SALE:  The auctioneer reserves the right to withdraw from sale any of the property listed or to sell at this sale property not listed, and also reserves the right to group one or more lots into one or more selling lots or to subdivide into two or more selling lots.  Whenever the best interest of the seller will be served, the auctioneer reserves the right to sell all the property listed, in bulk.

 

RESERVE:  The auctioneer reserves the right to reject any and all bids.  On lots upon which there is a reserve, the auctioneer or his assigned agents, shall have the right to bid on behalf of the seller.

 

RECORDS:  The record of sale kept by the auctioneer and bookkeeper will be taken as final in the event of any dispute. 

 

INDEPENDENT CONTRACTOR:  The auctioneer is acting as an independent contractor only and is not responsible for the acts of its principals or sellers

 

ADDITIONAL TERMS AND CONDITIONS:  The auctioneer may add other terms and conditions of sale, such additional terms and conditions to be announced prior to the auction.
