We are not here to intentionally misrepresent equipment or mislead buyers with descriptions or pictures. However, there could be errors made in this catalog. Any errors made in describing items or picturing does NOT negate the buyer’s responsibility to pay for their purchases. Sales will not be invalidated due to catalog inaccuracies. Buyer is responsible to inspect the equipment to verify specifications and condition. We make every effort to correct any errors before the lot hits the Auction Block. It is the buyer’s responsibility to make sure each item meets their needs before placing a bid. Upon acceptance of these Terms & Conditions, you are entering into a binding contract. There are no refunds or bid cancellations. The registered bidder is personally responsible, legally and financially for all auction items bid upon whether representing one's self or acting as as agent. An online bid accepted at public auction is a legal and binding contract to purchase. Any bidder who fails to follow through with a purchase will have their bidding privileges revoked from all future seller auction events and may be pursued for civil and/or criminal violations. ** It is important to listen to all announcements made by the auctioneer during the auction. The announcements made the day of sale will supersede any written descriptions. **Failure to make payment in full to the Auctioneer will result in Penalty Charges. Regardless of circumstance, failure to pay for the item(s) that you are the successful bidder on will result in a penalty/ no sale/ restocking fee. This penalty must be paid to the Auction Company as agreed in these Terms & Conditions, in addition to retain your bidding privileges with Shetron Auction & Equipment, LLC, Proxibid and their affiliated websites. A $1,500.00 Credit Card Authorization is required to participate in online bidding for this auction. If you are not a successful bidder, your credit card will not be charged, and the hold will be released within approximately 10 business days after the Auction Date. Your credit card hold/deposit of $1,500 will be applied to your purchase unless other arrangements have been made. A refund check will be mailed out if other payments are made after the hold/deposit is processed. 1) Shetron Auction & Equipment. LLC charges a 10% Buyer's Premium on each item. In addition, there is a 2% Internet Purchase Fee on each item. An additional 4% will be added if paying by Credit Card and 6% Sales Tax- unless you are tax exempt. ** There is NO CAP on the Buyer's Premiums.** Please Bid Accordingly ** There is a $35.00 administrative fee For title work. 2) Applicable State of PA Sales Tax of 6% will be charged on all Lots unless you are exempt from Sales Tax and you provide PA tax exemption form and exception certificates that are acceptable to the State of PA. 3) Payment in full must be made no later than 2 Business Days after the auction in the form Cash, Wire Transfer, Cashier's Check or Credit Card. An additional 4% will be added if paying by Visa, Mastercard, or Discover. 4) All purchases must be removed from the premises no later than 7 business days after the auction. Storage fees may apply. If lots are left on lot more than 30 days, the lots will be resold by auction house to cover storage fees, etc.- unless previous arrangements have been met. 5) Bidders are held personally liable for any bids made with their Bidding Number. 6) The highest bidder for each Lot shall be the Purchaser, and in the event of any dispute the Auctioneers shall have absolute discretion either to settle such dispute or to re-offer the lot for re-sale. 7) The Auctioneer, Proxibid and Bid Spotter accept no liability for loss or damage howsoever arising from any Lots not presented for sale. 8) The Auctioneer, Proxibid and Bid Spotter have described the Lot(s) in the catalog to the best of their ability and belief. The catalog is a guide only. The Auctioneer, Bid Spotter and Proxibid undertake no liability whatever in respect of any faults, deficiencies and errors of any description, oral or printed, nor do they accept responsibility for the authenticity, genuineness, origin, age, condition or quality of any Lot(s) and all statements as to these matters whether contained in the catalog or made orally are statements of opinion only and not to be taken as being or implying a statement or representation of fact. 9) Each and every Lot is sold 'as is, where is'. The Auctioneer, Bid Spotter and Proxibid provide no guarantees or warranties (express or implied) in respect of the Equipment contained in the Lot. All representations made by the Auctioneer, Bid Spotter and Proxibid, its servants or agents are to be considered lay opinions only and the Auctioneer and Proxibid accept no liability for any purchase made by a Buyer in reliance upon them. Items are sold 'AS IS, WHERE IS.' Buy with the expectation that things will need repaired and you will make the repairs. All items sold with NO warranty written or otherwise expressed. Servicing the equipment is not included. 10) As a condition to registration and bidding, Buyer agrees that Buyer will not, under any circumstance, initiate a chargeback to Buyer's credit card. Buyer further agrees that Buyer is waiving any chargeback rights that may exist under the agreement between Buyer and Buyer's credit card company. Should a chargeback be initiated by Buyer, these terms and conditions will be conclusive evidence of Buyer's waiver of any chargeback rights. 11) The Buyer agrees to insure the Equipment purchased against all losses from the Auction Date until removal of the Equipment by the Buyer. 12) The Buyer acknowledges he/she has read and agrees to be bound by the additional terms and conditions set forth.
